日本の労働法の基礎知識――外国籍労働者が知っておくべき権利と保護

A critical fact every foreign professional in Japan must know: Japan's Labor Standards Act applies to ALL workers in Japan, regardless of nationality. Even undocumented workers are legally protected.

Yet over 70% of workplaces employing foreign workers had labor law violations (MHLW 2024 survey). Unpaid overtime, denied paid leave, unfair dismissal - these cannot be excused by ignorance.

This article covers the fundamental labor rights you have and how to protect yourself.

5 fundamental rights of foreign workers

1. Working Hour Limits

Maximum 8 hours/day, 40 hours/week.
- 45+ min break for 6+ hr shifts, 60+ min for 8+ hr
- At least 1 day off per week
- Overtime requires a 36 Agreement + premium pay

2. Overtime Pay

Overtime premiums are identical for Japanese and foreign workers.
- Regular overtime: 25%+ premium
- Late night (10PM-5AM): 25%+ premium
- Over 60hrs/month: 50%+ premium (since 2023)
- If 'deemed overtime' is included in salary, hours exceeding it must be paid additionally.

3. Paid Leave

10 days of paid leave after 6 months of employment (80%+ attendance).
- Increases up to 20 days with tenure
- Minimum 5 days/year must be taken (mandatory since 2019)
- Part-time workers also receive proportional paid leave

4. Dismissal Protection

Dismissal without reasonable cause is invalid.
- 30 days advance notice or 30 days severance required
- 'Easy to fire because of visa' is completely illegal
- Discrimination based on nationality violates Article 3 of the Labor Standards Act

5. Social Insurance

Workers averaging 30+ hrs/week must be enrolled regardless of nationality.
- Health insurance (70% coverage)
- Employee pension (lump-sum withdrawal available upon leaving Japan)
- Employment insurance (unemployment benefits)
- Workers' compensation (work injuries)

5 common troubles foreign workers face

1: Unpaid overtime
Some companies use 'deemed overtime' to avoid paying excess hours. If your actual hours exceed the deemed amount, additional pay is legally required.
2: Denied paid leave
Refusing leave during 'busy periods' is not illegal, but the company must offer alternative dates. Failing to grant 5 days/year is punishable.
3: Not enrolled in social insurance
'Foreigners do not need insurance' is completely illegal. Eligible workers must be enrolled.
4: Sudden dismissal
'Do not come tomorrow' is illegal. 30-day notice or severance is required.
5: Visa used as leverage
'We will not renew your visa' or refusing to accept resignation are illegal threats. Report to authorities.

2026 update: Major labor law reform under discussion

Based on a January 2025 report, Japan is considering its first major labor law reform in approximately 40 years.

Key proposals:
- Mandatory 11-hour rest between shifts
- Ban on 14+ consecutive work days
- 'Right to disconnect' guidelines
- Standardized paid leave wage calculation
- Revised overtime rules for side-job workers

The bill was expected for the 2026 Diet session but the timeline remains fluid. Many proposed changes would benefit foreign professionals.
